The Lizard Lighthouse, Incorporated hereby agrees to transfer to Adoptee(s), the animal listed above in exchange for consideration of the adoption amount listed above.
Adoptee(s) agree that this pet will be adopted as a companion and family member. Adoptee(s) further agree to provide the pet with loving, humane, and proper care, including adequate food, water, attention, medical care, exercise, and training. Adoptee(s) further agree to house the pet indoors and not leave the animal outside when Adoptee(s) or other family members are not on the premises. Adoptee(s) also agree that all medical treatment specified as necessary by The Lizard Lighthouse, Incorporated, not completed at adoption, will be done by a veterinarian of the rescue at the required time.
Adoptee(s) agree that they are taking the pet “as is” and with any and all faults, including, but not limited to, medical, behavioral, or otherwise. All steps are taken to ensure that only healthy animals are made available for adoption; however, previous exposure to disease or injury or predisposition to illness and medical conditions may not be apparent or known at the time of adoption. The Lizard Lighthouse, Incorporated does not make any representations, warranties, or guarantees, expressed or implied, regarding the suitability or fitness of this animal to the Adoptee(s).
Adoptee(s) agree that in no event will the pet be surrendered to a shelter or research facility. Adoptee(s) further agree that the pet will not be abandoned, sold, or gifted to a third party under any circumstances. If, for any reason, Adoptee(s) decide to surrender the pet, Adoptee(s) hereby agree to willingly return the pet to The Lizard Lighthouse, Incorporated at no cost to The Lizard Lighthouse, Incorporated. By doing so, this Agreement shall terminate, and Adoptee(s) will immediately relinquish all rights to the pet, and The Lizard Lighthouse, Incorporated will become the sole owner of the pet.
If Adoptee(s) do not fulfill all obligations with respect to the care of the pet as described in this Agreement and as determined in the sole and absolute discretion of The Lizard Lighthouse, Incorporated and its medical professionals, Adoptee(s) hereby grant The Lizard Lighthouse, Incorporated complete and absolute authority to reclaim immediate possession of the pet, in which case this Agreement shall terminate, and Adoptee(s) relinquish all rights to the pet, and The Lizard Lighthouse, Incorporated will become the sole owner of the pet.
Adoptee(s) agree that The Lizard Lighthouse, Incorporated. shall not be responsible for bodily injury or property damage caused by the animal or its Adoptee(s). Adoptee(s) hereby specifically assume the sole responsibility for and agree to indemnify and hold harmless The Lizard Lighthouse, Incorporated from any and all claims, demands, and liabilities in connection with and relating to the animal, whether directly or indirectly.
Adoptee(s) agree that in the event of a dispute between the parties, such dispute will be subject to binding arbitration under the rules adopted by the State of Nebraska and administered by the AAA (American Arbitration Association).
This Agreement shall be interpreted in accordance with the laws of the State of Nebraska. If any term of this Agreement is to any extent invalid, illegal, or incapable of being enforced, such term shall be excluded to the extent of such invalidity, illegality, or unenforceability; all other terms hereof shall remain in full force and effect.
If Adoptee(s) are found in breach of this Agreement, The Lizard Lighthouse, Incorporated will be entitled to enforce its rights by action for specific performance. Adoptee(s) agree to pay all expenses incurred by The Lizard Lighthouse, Incorporated in enforcing its rights under this Agreement, including reasonable attorney’s fees.
